Nature of Proceeding: Motion for Attorney Fees

Judgment Creditor’s motion for attorneys’ fees is UNOPPOSED and is GRANTED as follows.

Judgment Creditor requests $5,471.92 in attorneys’ fees and costs incurred to enforce and collect on a sister-state judgment. On 3/4/2013, judgment was entered in Arizona. The judgment was domesticated in California on 3/24/2017. Pursuant to the Arizona judgment, Judgment Creditor was awarded “all reasonable costs and attorneys’ fees incurred by Plaintiff after entry of this judgment in collecting the amounts awarded herein.”

Judgment Creditor moves for fees and costs pursuant to the CC&Rs which were the subject of the underlying lawsuit, as well as CCP 685.040 which entitles the judgment creditor to reasonable attorneys’ fees and costs incurred in enforcing the judgment.

The Court has reviewed invoices and attorneys’ billing rates and finds them to be reasonable and necessary. The Court, however, will deduct $196 from the requested amount. The deducted amount represents the “anticipated” time to attend a hearing and $86 for Court Call fees. Since the motion is unopposed, the Court does not expect that fees to attend the hearing or for Court Call will be incurred.

Therefore, the Court awards a total of $5,275.92 in attorneys’ fees and costs.

The minute order is effective immediately. No formal order pursuant to CRC Rule 3.1312 or further notice is required.
